USCIS has reached the 65,000 H-1B visa cap for the fiscal year 2018. USCIS has also reached the 20,000 H-1B Master’s cap. Petitions that are exempt from the cap will continue to be processed, but all others not yet selected will be rejected and returned. Petitions that will continue to be accepted include those that extend, change terms of employment or employer, or allow consecutive and subsequent H-1B employment of a current H-1B worker.

On December 9, President Obama signed H.R. 2028, which extended four immigration programs including The Conrad 30 J Waiver, the Non-Minister Special Immigrant Religious Worker Visa, the EB-5 Regional Center Visa Program, and the E-Verify Program. The EB-5 Regional Center Program was not reformed and the H-2B Returning Worker Exemption was not extended through the signing of this bill.
