USCIS announces the temporary suspension of premium processing for the upcoming H-1B FY 2021 quota cases

LAW IMM Analysis:

USCIS has announced that H-1B petitioners will not be able to request for premium processing service for the FY2021 H-1B quota petitions, at least not initially.

Just like last year (2019), the USCIS will be allowing premium processing service for H-1B quota petitions this year in stages:

  1. First, USCIS will permit premium processing option for those H-1Bquota petitions in which the I-129 H-1B petition is requesting for change of status from F-1 nonimmigrant student status to H-1B worker status. This will start up no later than May 27, 2020.

The USCIS will announce the exact date as it approaches the start date.

  1. After that, USCIS will resume premium processing for the rest of the FY 2021 H-1B quota petitions no earlier than June 29, 2020. USCIS will also announce the formal start date just before that start date as well.

When the opportunity does become available, the H-1B petitioners will be able to upgrade the filed and pending H-1B quota petitions to premium processing service by submitting the form I-907, along with the requisite premium processing fee, and the copy of the I-797 H-1B petition receipt notice to the USCIS.

Please also note that the USCIS will continue to accept premium processing service request for non-H-1B quota petitions, such as transfers, and extensions, and amendments.
