USCIS extends and expands the suspension of H-1B premium processing option for certain H-1B petitions

In an effort to reduce long backlogs and delays at the USCIS Service Centers, the USCIS has decided to extend the suspension of premium processing option for H-1B quota petitions (those that are filed with either the Vermont Service Center, or the California Service Center). In addition, USCIS will also suspend the premium processing option for H-1B petitions that are filed as change of employer, and amendment petitions.

Do note that the premium processing option will remain valid for H-1B petitions filed by cap-exempt H-1B employers (such as universities and research institutions), as well as H-1B petitions filed with no change in previously approved employment (such as H-1B extension with the same employer).

This premium processing suspension for certain H-1B petitions will last until February 19, 2019. USCIS explains that the reason for this suspension of premium processing is because they need time to clear their backlog of H-1B I-129 cases.

This suspension of premium processing will NOT impact other petitions that use form I-129 (L-1, and R-1). Premium processing for those types of cases will still be allowed.
